1. Scope and Acceptance
These Terms cover:
Ride‑Hailing Services: Connecting passengers with independent transportation providers.
Non‑Ride‑Hailing Services: Encompassing delivery services (for food, groceries, goods, etc.), integrated payment features, and other services.
Privacy Practices: How we collect, use, store, and protect your personal data.
By using the Platform, you expressly agree to all provisions in this Agreement, including any supplemental policies applicable to specific Services. No part of this Agreement is repetitive except where similar provisions apply across both service types.
2. Definitions
Company / CityCab: CityCab Technologies Limited Liability Company.
Platform: Our website, mobile application(s), and related online resources that enable you to access and use our Services.
User / Account Holder: Any individual who registers and uses the Platform.
Ride‑Hailing Services: Services that enable a User (Passenger) to arrange a transportation service with an independent Safeer.
Non‑Ride‑Hailing Services: Services such as delivery (food, groceries, parcels, etc.), in‑app payment solutions, and other related services offered via the Platform.
Safeers: Independent contractors who provide ride‑hailing and/or delivery services. They are not employees or agents of CityCab.
Partner: Third‑party companies (e.g., restaurants, stores) whose products or services may be accessed via the Platform; separate terms may apply directly between you and such Partners.
Charges: The fees, inclusive of applicable taxes, you agree to pay in exchange for the Services.
Promo Codes: Promotional discounts that, if offered, are subject to additional terms.
Content: Any text, graphics, images, audio, video, or other materials provided on the Platform.
3. User Account, Eligibility, and Use of the Platform
3.1. Registration and Account Security
You must create an Account to access our Services, and you agree to provide complete, accurate, and current information.
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and capable of forming a legally binding contract.
You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities performed under your Account. Notify us immediately of any unauthorized use.
3.2. Permitted Uses
You may use the Platform for personal, non-commercial purposes only.
You shall comply with all applicable laws and refrain from any abusive, fraudulent, or harmful behavior. Misuse of the Platform—including unauthorized attempts to access or disrupt the Platform—is strictly prohibited.
4. Services Provided
4.1. Ride‑Hailing Services
Intermediation: The Platform connects Passengers with independent Safeers. All transportation is provided by Safeers, and a separate direct contract is formed between you and the Safeer for the actual ride.
Independent Contractor: Safeers are independent contractors. CityCab does not employ, control, or guarantee their performance beyond providing the technological connection.
4.2. Non‑Ride‑Hailing Services
Scope: The Platform also facilitates the ordering of delivery services, including food, groceries, documents, and other goods.
Item Restrictions: For delivery orders, prohibited items include cash, gold, jewelry, or other high‑value items. In addition, the declared value of any delivery must not exceed Lira 300,000.
Fulfillment: Depending on the service, delivery may be handled by Safeers or directly by a Partner (Self‑Delivery). In either case, CityCab acts solely as a technology facilitator, and the direct contractual relationship is with the independent provider or Partner.
Order Modifications: Once an order is placed, changes to the delivery address or order details may not be possible. Please confirm all details carefully before submission.
5. Payment Terms
Processing: Charges for Services are clearly stated at checkout and are payable via the secure payment methods provided on the Platform (e.g., cash, debit/credit cards, or licensed third-party payment gateways). CityCab does not store or directly process your payment card details.
Pre‑Authorization: In some instances, we may pre‑authorize an estimated amount on your payment method to ensure sufficient funds.
Promotional Offers: Any Promo Codes or discounts will be subject to their specific terms and cannot be combined unless expressly allowed.
Refunds and Cancellations: Charges are generally final and non‑refundable unless a cancellation is initiated by CityCab under circumstances specified herein. In the case of a cancelled order, any refunds will be processed using the same payment method used for the original transaction.
5.1 Rewards and Promotional Balance
Any rewards, promotional balance, or loyalty points credited to your Account are for use exclusively within the Platform to obtain discounts or promotional benefits. Such balance does not represent real money, is non-transferable, and cannot be withdrawn, redeemed for cash, or used outside the Platform.
6. Privacy Policy
6.1. Data Collection
Information You Provide: Includes your registration details, contact information, and any documents submitted (e.g., for identity verification of Safeers).
Automated Data: We collect data generated by your use of our Services, including geolocation, device information, transaction records, and usage statistics.
User‑Generated Content: Communications, feedback, ratings, and other data you share through the Platform.
6.2. Data Use
Service Provision: Your information is used to operate and improve our Services, verify identities (for safety and compliance), and to process payments.
Enhancement: We analyze usage data to optimize and personalize your experience.
Communications: You may receive service updates, notifications, and marketing communications (subject to your consent).
6.3. Data Sharing and Protection
Third Parties: We may share your data with trusted service providers and Partners solely for the purpose of facilitating your Services. Such parties are contractually obligated to maintain confidentiality.
Legal Compliance: We may disclose your information where required by law or to protect our rights.
Security: We implement industry‑standard technical and organizational measures to safeguard your data. While we strive to protect your information, no online system is completely secure.
7. Disclaimers; Limitation of Liability; and Indemnification
7.1. Disclaimers
“As Is” Basis: All Services are provided on an “as is” and “as available” basis without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non‑infringement.
Third‑Party Providers: CityCab does not guarantee the performance, quality, or reliability of Safeers or Partner‑provided Services.
7.2. Limitation of Liability
General Limitation: In no event shall CityCab or its Affiliates be liable for indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform or Services.
Cap on Liability: Subject to applicable law, CityCab’s total liability for any claim shall not exceed an amount equivalent to our fee from the original transaction.
7.3. Indemnification
You agree to indemnify and hold harmless CityCab and its Affiliates, officers, directors, agents, and employees from any claims, damages, or losses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law.
8. Dispute Resolution and Governing Law
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the applicable local jurisdiction.
Dispute Resolution: Any dispute arising out of or relating to this Agreement or the Services shall first be submitted to mediation. If unresolved within sixty (60) days, disputes shall be resolved by a local binding arbitration in in accordance with mutually agreed‑upon arbitration rules. All arbitration proceedings and related documents shall be kept confidential.
Jury Trial Waiver: You agree to waive your right to a jury trial and to participate as a class member in any litigation related to this Agreement.
9. General Provisions
Amendments: CityCab reserves the right to update these Terms and the Privacy Policy at any time by posting revised versions on the Platform. Continued use of the Platform indicates your acceptance of the changes.
Notices: Any notices required under this Agreement may be sent to the contact details associated with your Account.
Severability: If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will continue in full force.
Entire Agreement: This document, together with our Privacy Policy and any supplemental terms, constitutes the entire agreement between you and CityCab regarding your use of the Platform.
Assignment: Neither you nor CityCab may transfer or assign any rights or obligations under this Agreement without prior written consent.

11. Acknowledgment
